On November 7 2016, the Standing Committee of China’s National People’s Congress (“NPC”) passed China’s first Cybersecurity Law (the “Law”), which will take effect from 1st June 2017.
With its broad application, the new Law will have significant and long-lasting implications for companies operating in China and seeking to access the Chinese market. A widely discussed issue connected with this law is data local storage requirements. Another issue of concern is the obligation of companies to cooperate with Governamental agencies to facilitate invasive audits or investigations during law enforcement.
