我国《数据安全法》规定，国家建立数据分类分级保护制度，根据数据在经济社会发展中的重要程度，以及一旦遭到篡改、破坏、泄露或者非法获取、非法利用，对国家安全、公共利益或者个人、组织合法权益造成的危害程度，对数据实行分类分级保护。同时，有关部门应制定重要数据目录，加强对重要数据的保护。

随着相关工作持续推进，近期，数据安全与分类分级治理出现一系列新动向。例如，2024年3月19日，国务院办公厅印发《扎实推进高水平对外开放更大力度吸引和利用外资行动方案》，明确提出健全数据跨境流动规则，科学界定重要数据范围。3月20日，国家标准委批准发布推荐性国家标准GB/T 43697-2024 《数据安全技术 数据分类分级规则》以及作为规范性附录的《重要数据识别指南》，对企业的合规工作提出了进一步指引和要求。与此同时，部分行业、领域和地方在数据安全和分类分级治理方面，也出台了相关规定。

在这一背景下，中国欧盟商会有幸邀请国家工业信息安全发展研究中心科技委成员、产业促进所研究部主任杨晓伟博士和世辉律师事务所合伙人王新锐，就近期数据安全与分类分级治理相关工作和动态进行分享。

The main topics for this meeting will be the revision of the activities of the WGs in 2023, as well as the establishment of the WG priorities for 2024 and the discussion on the upcoming ICT WG and Cybersecurity Sub-WG Position Paper. Thus, members are strongly encouraged to join the discussion and provide input on the key issues which will likely shape the activities of these two Working Groups this year. Throughout the past few years, the EU has been revamping its regulatory toolbox in order to better address emerging economic, geopolitical, technological and climate challenges. This expanding toolbox includes instruments aiming at combatting economic distortions and creating a level-playing field in the Single Market, ensuring reciprocity with third countries in areas like procurement and combatting coercive actions initiated by those countries, fostering sustainable processes and preventing carbon leakage among industry players. As number of these regulations will impact the China operations of European companies, the European Chamber brings to you the Interpreting the EU’s Toolbox Series, where experts will provide an overview of the instruments that are being rolled out. The fourth episode of the series will focus on the Anti-Coercion Instrument (ACI), and it will take place on 5th March 16:00 online.

The second episode of the series will focus on the International Procurement Instrument (IPI), which officially entered into force sixty days following its publication in the Official Journal of the EU on 30th June 2022. On Thursday 14th September at 16:00, Ms Lilia Petrova and Mr Nicolas Grosse, Trade Affairs Officers at the European Commission, will provide an online overview of the IPI.

2022年12月13日，工信部发布了《工业和信息化领域数据安全管理办法（试行）》 。《办法》作为工业和信息化领域数据安全管理顶层制度文件，将贯彻落实《数据安全法》等法律法规有关要求，指导工业和信息化领域数据安全的实施落地。为此，《办法》提出了一系列合规要求，包括但不限于将数据分为一般数据、重要数据、核心数据并进行分类分级管理，重要数据、核心数据目录备案，以及加强数据全生命周期安全管理。

鉴于《办法》 对企业的重要性，中国欧盟商会有幸邀请工信部网络安全管理局数据安全处张洪副处长莅临工作组闭门会议，就《办法》有关要求、实施情况、前期试点工作经验以及后续工作重点进行解读 ，并与企业交流 ，促进企业的合规工作。

我国《个人信息保护法》确立了以告知-同意为主要合法性基础的个人信息处理规则。作为支撑上位法告知-同意有关要求落地的重要参考，2023年5月23日，推荐性国家标准GB/T 42574—2023 《信息安全技术 个人信息处理中告知和同意的实施指南》正式发布，并将于2023年12月1日实施。
该标准明确了告知个人信息处理规则、取得个人同意的具体实施方法和步骤，包括单独同意和书面同意的实施，并对APP、云计算、车内、快递物流、互联网金融等13个常见个人信息处理情形给出了细化说明。
值此之际，中国欧盟商会网络安全子工作组及标准与合格评定工作组有幸邀请该标准起草专家（已确认），对标准重点内容及其落地实施进行解读，并与会员企业交流探讨。
