5月30日,国家互联网信息办公室发布《个人信息出境标准合同备案指南(第一版)》(“备案指南”),为6月1日起执行标准合同的备案工作提供了指引,对个人信息出境标准合同备案方式、备案流程、备案材料等具体要求作出了说明。

On 30th May, the Cyberspace Administration of China (CAC) issued the Guidelines for Filing Standard Contracts for the Cross-Border Transfer of Personal Information (First Edition) (‘Filing Guidelines’), which provided guidance for the filing of standard contracts effective as of 1st June. The guidelines provided specific requirements for the filing methods, filing procedures, and filing materials for Standard Contract for Cross-border Transfer of Personal Information.

At the end of 2022, the Central Committee of the Communist Party of China and the State Council issued the Opinions on Building Basic Systems for Data to Better Give Full Play to the Role of Data Resources (Twenty Data Measures), proposing twenty measures for the establishment of a property system, a circulation and trading system, an income distribution system, and a governance system. The Twenty Data Measures aim at fully leveraging China’s abundant data resources and rich application scenarios, tapping into the potential of data resources, and shedding light on the Chinese-style data governance.

On 28th October 2022, the Ministry of Industry and Information Technology (MIIT) issued the Administrative Regulation on Road Motor Vehicle Manufacturer and Product Admission (Draft for Comments) (Administrative Regulation on Admission). Five days later, the MIIT and the Ministry of Public Security jointly issued the Notice on Conducting Pilot Work of ICV Access and On-road Driving (Draft for Comment) (Draft Pilot Notice). The release of these two draft regulations is of great significance for future development of China’s auto industry, in particular that of smart vehicles.

Despite presenting serious challenges throughout 2020, COVID-19 has not managed to impact the ineluctable roll-out of new, significant pieces of Cybersecurity implementation rules and draft laws in China. One notable release was the draft Data Security Law in July 2020. China’s determination to more-stringently regulate its cyberspace have been paralleled by a doubling of compliance endeavours from foreign businesses in China, which has increased both the cost and the operational burden of doing business, at least in the short-term.
In order to examine how the Cybersecurity Law and the Data Security Draft Law will coexist, and what the long-term impact will be on European companies operating in China, the European Chamber as assembled a distinguished group of government representatives, lawyers, security experts and industry representatives to discuss this topic at its annual Cybersecurity Conference.

On June 1st, 2020, the Chinese Central Committee and the State Council jointly released the Overall Plan for the Construction of Hainan Free Trade Port (“the Masterplan”), a large-scale plan to transform the entire island province into a free trade port (FTP) – making it the largest special free trade zone in China. The Masterplan laid out a series of special policies for Hainan – liberalization of trade of goods and services, facilitation of investment, opening-up of key sectors, and free exchange of people, capital, and data. Coupled with preferential policies of the Hainan Bo’ao Lecheng International Medical Tourism Pilot Zone, Hainan is expected to be the rising hub of new investment and business opportunities.

One of the mottoes of the new Commission under the auspices of President Ursula Von der Leyen has been to “strive for more at home in order to lead in the world”. Throughout the new leadership’s 100 first days, a number of road-maps that will likely pave the way of Europe’s strategic development and global positioning in the next five years have been developed. Looking at EU-China cooperation and competition, perhaps two of the most relevant road-maps devised by the new Commission are its Artificial Intelligence (AI) White Paper – released on 19th February – and its industrial strategy – rolled out on 10th March.
