5月30日,国家互联网信息办公室发布《个人信息出境标准合同备案指南(第一版)》(“备案指南”),为6月1日起执行标准合同的备案工作提供了指引,对个人信息出境标准合同备案方式、备案流程、备案材料等具体要求作出了说明。
On 30th May, the Cyberspace Administration of China (CAC) issued the Guidelines for Filing Standard Contracts for the Cross-Border Transfer of Personal Information (First Edition) (‘Filing Guidelines’), which provided guidance for the filing of standard contracts effective as of 1st June. The guidelines provided specific requirements for the filing methods, filing procedures, and filing materials for Standard Contract for Cross-border Transfer of Personal Information.
《个人信息出境标准合同备案指南》的出台标志着个人信息标准合同机制落地要求的进一步深入,数据出境合规监管制度的不断完善。鉴于标准合同是企业最为普遍适用的个人信息跨境传输机制,且备案指南对备案工作要求严格,为了最大限度地避免企业备案不通过的风险,因此,在进行标准合同备案前扎实准备备案材料尤为重要。
The release of the ‘Filing Guidelines’ marks a further deepening of the requirements for the implementation of the personal information standard contract, as well as the continuous improvement of the regulatory system for cross-border data compliance. In view of the fact that the standard contract is the most universally applicable cross-border transmission mechanism of personal information for enterprises, and the ‘Filing Guidelines’ have strict requirements, it is crucial for enterprises to thoroughly prepare for the filing of standard contracts in order to avoid the risk of failing to pass the filing process.
为了帮助企业全面理解标准合同的备案要求,有效地开展标准合同的签署和备案工作,中国欧盟商会网络安全子工作组副主席李晓蓓 (Barbara Li) 将就我国《个人信息出境标准合同备案指南(第一版)》的要点进行全面解读,对跨国企业落地标准合同可能遇到的痛点和难点进行梳理,并就在华跨国企业如何开展个人信息保护影响评估、签署标准合同、以及有效完成标准合同备案展开讨论并提出合规建议。
In order to help enterprises fully understand the filing requirements of the Standard Contracts, and effectively carry out the signing and filing of Standard Contracts, the European Chamber is delighted to invite Barbara Li, Vice Chair of the Cybersecurity Sub-Working Group, to share her insights regarding the ‘Filing Guidelines’, address key challenges facing MNCs in implementing the Standard Contracts, discuss how to effectively carrying out the personal information protection impact assessment, signing the standard contracts and completing the filing for the standard contracts, and propose compliance recommendations for MNCs in China.

Ms. Caroline Chen
Caroline is currently (2021-now) in charge of Strategy & Ecosystems in Detecon Consulting China, a subsidiary of Deutsche Telekom. She leads the local marketing and ecosystems buildup and works in strategy consulting project on ICT topics for international clients.
Caroline Chen was the Head of Business Development in Deutsche Telekom Representative Office Beijing. She led the local BD Team, in charge of regulation tracking, partnering development, standardization coordination and innovation scouting for Deutsche Telekom group units. She has been with Deutsche Telekom starting from 2012.
In addition to the work at Deutsche Telekom, Caroline Chen has been actively engaged in European Chamber and has been elected for the Vice Chair and then the Chair of ICT working group in the past several years. As one of the leading pens for the ICT position paper, she contributed substantially to the key recommendations writing and editing. She also initiated and actively participated at the dialogues between governmental bodies and ICT working group in order to promote the common interests of European industry in China.
Prior to joining DT, Caroline Chen was an analyst in an American consulting firm Marbridge Consulting, where she worked mainly for clients including European telecom companies and American venture capitals & PEs for understanding the Chinese telecom and internet industries.
Caroline Chen was graduated from Central University of Finance & Economics with a master’s degree in economics, and from Beijing Foreign Studies University with a Bachelor Degree in English Literature.

Ms. Barbara Li
Barbara is a partner based in Beijing. With almost three decades’ experience working in a senior in-house legal role at the Beijing and London offices of leading international firms, as well as providing business consultancy services at PwC, Barbara brings a wealth of knowledge to advising international and Chinese companies and financial institutions on doing business in China and globally. She focuses her practice on complex, cross-border M&As, joint ventures, strategic alliances and foreign direct investment in a wide range of industries including the high-tech, telecom, energy, infrastructure, automotive, pharma and high-end manufacturing industries. She also counsels Chinese companies on their outbound strategies and major transactions.
Barbara has a particular interest in the cyber, data, technology and FinTech sectors, with significant experience advising international companies and financial institutions on navigating China’s evolving legal regime governing data and cybersecurity. She is regularly engaged by clients to provide legal support on high-stakes data and cybersecurity-related issues including managing complex, cross-border data transfers, the digital transformation of businesses, and the deployment of emerging technologies such as AI, cloud computing and blockchain. Barbara also advises Chinese companies on global data compliance projects under the laws of other countries, such as the EU GDPR. She is recognised as a Certified Information Privacy Professional (CIPP/EU) by the International Association of Privacy Professionals (IAPP) and is an IAPP-designated writer for the Asia-Pacific region.
Barbara is widely recognised in the Chinese market as an eminent data/tech lawyer and is described as “having extensive experience in complex TMT regulatory issues” by Legal 500. She is ranked as a leading individual in corporate, M&A, TMT and FinTech by various legal directories, including Chambers, Legal 500, Asian Legal Business, IFLR1000 and WhichLawyer, and received the China Top 15 TMT Lawyer award 2020 from Asian Legal Business.
Benefiting from her in-house experience, Barbara works closely with the industry and is frequently invited to share her insights at premier international professional and industry conferences organised by the IAPP, the Asia Privacy Forum and the Economist Corporate Intelligence Network, among others. She served as the vice chair of the Cybersecurity Sub-Working Group and the Construction Working Group of the EU Chamber of Commerce in China for several years.
