2. 海关就企业特许权使用费项目进行价格质疑或稽查的涉税风险
Tax Exposure of Customs Price Questioning and Audit regarding Royalty Issue.
近期，海关总署及各地海关对企业向境外支付特许权使用费问题颇为关注。
Recently, China General Administration of Customs and local Customs pay much close attention to the enterprises' overseas royalty payment.
（1） 企业向境外支付的特许权使用费是否符合213号令中提到的应并入进口货物完税价格的情形？
Do the royalties paid from domestic enterprise to overseas party meet the terms that it shall be included in duty-paid price of imported goods mentioned in Order of the General Administration of Customs No.213?
（2）企业目前签订的特许权使用费合同是否存在风险？
Dose the risk exist in the current enterprise's signed royalty contracts?
（3）企业在应对海关提出的价格质疑或稽查时应该注意哪些问题？
What issues shall be noticed when enterprise faces price questioning and audit raised by Customs?
（4）这些问题和风险都值得企业关注和重视，即使企业日后有可能收到海关价格质疑通知书或专项稽查通知书，也会有所心理准备并可以沉着应对。
Considering the probabilities of facing price questioning or special audit from Customs, enterprises should pay close attentions to these issues and risks to prepare sufficiently and defend calmly in the future.
Speaker 演讲嘉宾：
Mr. Frank Tang, Tax Managing Partner of Deloitte Western China
and also one of the technical experts with rich experience in indirect tax planning, has over 25 years of tax experience and specializes in the delivery of professional services including Tax Compliance Review, Transfer Pricing Audit Defense, Export Tax Refund, Foreign Exchange and Customs services and etc. Frank's advisory clients include leading multinational as well as domestic enterprises in diversified industries.
Before joining Deloitte in 2001, Frank was senior official at Tianjin Municipal State Tax Bureau Foreign Taxation and Administration Sub-bureau for 14 years. Frank is also the tax partner and leader partner of Transfer Pricing Service of Deloitte Tianjin and the tax managing partner of Deloitte Dalian.
汤卫东先生是德勤华西区税务主管合伙人，也是德勤中国最具丰富间接税税务筹划经验的技术专家之一。汤先生拥有近二十五年的税务经验，特别擅长为客户提供税务合规性审阅、转让定价抗辨、出口退税、外汇及海关咨询等专业服务。汤先生为不同行业的跨国及国内公司提供常年税务顾问服务。

Ms. Grace Yang, tax manager with Deloitte Touche Tohmatsu LLP - Tianjin Branch, has almost 10 years' experience in tax consulting service and has achieved great success in her practice when dealing with tax advisory, transfer pricing, tax compliance review, Customs and Indirect tax consulting and negotiation service. Grace specializes in providing Customs and Indirect Tax consulting and negotiation services, especially assisting clients in consultation and negotiation with Custom Authorities for processing trade, royalty issues.
杨帆女士是德勤华永会计师事务所有限公司天津分所税务及商务咨询部税务经理，拥有将近10年的专业税务咨询经验。杨女士参与税务筹划、转让定价、税务咨询、税务合规性审阅、税务申报、海关及间接税咨询及交涉等多项涉及广泛业务领域项目。她也在海关及间接税服务方面积累了丰富的经验，曾经多次协助客户进行加工贸易、特许权使用费项目的咨询，并协助应对海关稽查。
