十三届全国人大常委会第五次会议8月31日表决通过电子商务法,共七章89条,对电子商务经营者、电子商务合同的订立与履行、电子商务争议解决、电子商务促进、法律责任等进行详细规定,将自2019年1月1日起施行。多次公开征求意见,历经四次审议,电子商务法终于问世。电子商务法的出台,对规范电商领域各主体行为,维护电商行业市场秩序,引导电商行业持续健康发展都有重要意义。消费者合法权益得到了哪些更好保护?平台经营者的界定与责任?电子商务行业发展又得到了怎样的规范和支持?电子商务有哪些特殊合规要求?跨境电商是否适用于电商法?欧盟商会在电商法执行之际,特邀冯晓鹏金杜律师事务所合规业务部合伙人和阿拉木斯中国电子商务协会政策法律委员会副主任就《电子商务法》出台过程中特别受到关注的以上几个方面进行解读。

欧盟委员会智库——欧洲政治战略中心一项近期研究显示,人工智能及其应用将大幅提高效率和生产率,显著降低制造业成本。2018年4月25日,欧盟委员会发布了名为《欧盟人工智能》的政策文件,提出了一系列旨在增强欧盟在该领域竞争力的举措。

与此同时,中国政府也出台了诸多人工智能相关的战略政策,旨在将中国转变为全球人工智能的领军者。习近平在中共中央政治局2018年10月31日就人工智能发展现状和趋势的学习时再次强调,人工智能是新一轮科技革命和产业变革的重要驱动力量,并呼吁推动新一代人工智能健康发展。

值此之际,中国欧盟商会非常荣幸邀请人工智能领域的学者和企业代表,共同探讨人工智能在传统领域的应用,以及传统企业应如何在人工智能时代保持话语权。

Roland Berger’s annual E-mobility index (released September) revealed that in the field of New Energy Vehicles (NEV’s) China continues to lead the pack. This assessment was based largely on the strength of continued market development where sales for battery and plug-in hybrid electric vehicles increased 70%, representing 2.2% of all sales in the world’s largest automotive market.

As part of a broader set of institutional reforms announced at the 19th Party Congress, China implemented one of the largest re-organizations of regulatory authorities in modern Chinese legal history. China's three competition authorities (specialized divisions within the Ministry of Commerce, the National Development and Reform Commission, and the State Administration for Industry and Commerce), corporate governance regulatory (the Administration of Industry and Commerce), product quality organization (AQSIQ), and several other regulatory bodies have now been consolidated into the State Administration for Market Regulation (SAMR). This new mega-enforcement agency is likely to have a profound impact on Chinese law enforcement.

In his new book “China’s Great Wall of Debt”, Dinny McMahon, suggests that China has powered ahead for as long as it has not because it is immune to crises, but because its government has so far managed to intervene to stave them off. His book argues, specifically in relation to rising debt levels, that this offers no guarantee that the debt problem can be pushed down the road indefinitely.
