Comments on "Processing Regulations on the Arbitration to Labor and Personnel Dispute (Draft for Comments)"

In March 2017, the Ministry of Human Resources and Social Security has issued a Call-for-Comments on < Processing Regulations on the Arbitration to Labor and Personnel Dispute (Draft) >. The European Chamber Human Resources Working Group; Human Resources Working Forum; and Compliance & Business Ethics Working Group on behalf of member companies, submitted to the Ministry of Human Resources and Social Security their consolidated comments, introducing the summary procedure, collective labor and personnel dispute arbitration procedure and mediation procedure into the Regulations. Compared with the current Regulations, the Draft is more comprehensive, the expression is more precise and the new articles are easier to be taken into practice. The mediation and arbitration procedure is more specific, clear and normative. Besides, the Draft also makes a closer connection with the PRC Civil Procedure Law. Overall, the Draft can contribute to the further improvement of processing regulations on arbitration to labor and personnel disputes, improve the capability of arbitral institutes to deal with disputes and help arbitral institutes deal with disputes more efficiently.
