Over the past decade, American legal and regulatory authorities have subjected large foreign companies to extraterritorial actions. Paying large fines, which can exceed $1bn, has often been the only way finally to settle such accusations of serious misconduct—typically, corruption or breaching sanctions—outside America.
In the past, such cases, rarely went to trial, and the firms involved were limited. However, in the past couple of years there have been more known cases, such as Alstom's.
In April 2013, Frédéric Pierucci, an executive of Alstom, a French power and transportation conglomerate, was arrested by the FBI when his plane arrived at New York's John F. Kennedy International Airport. He was charged with bribing Indonesian officials to win a power plant contract. His arrest ran parallel to the largest business acquisition by the American General Electric (GE) of its French rival Alstom's energy business.
Shortly after, Pierucci pleaded guilty in the U.S., he was fired from Alstom and the company stopped paying his legal fees. He spent over two years behind bars and three more years on bail. He’s now back in France advising companies and employees on the U.S. anti-corruption law and how best to protect themselves and has co-authored China’s best-seller “The American Trap”.
The European Union Chamber of Commerce in China, in cooperation with the Swiss Chamber of Commerce in China, is pleased to welcome Mr Frédéric Pierucci, CEO of Ikarian, Mr Markus Asshoff, Partner at Taylor Wessing Paris, and Ms Cara Meng, Senior Associate at Taylor Wessing China, to share their lessons from the frontline on dealing with U.S. Anti-Corruption Law and share their tips on how businesses can better protect themselves.

Mr. David Du
David Du is the General Counsel for Bosch in AP since January 2015. He leads 6 legal teams consisting of 42 lawyers to support the Bosch operation in AP. Prior to that, he was the General Counsel and Compliance Officer for Bosch in China. David has been assisting Bosch management to ensure compliance in its China operation which has 50,000 employees and 65 entities.
David is a Chinese lawyer and Certified Tax Practitioner. He is the Chair of the Compliance Working Group in the European Chamber of Commerce China since March 2018, and the vice-Chair from April 2015 to March 2018. David is also an arbitrator in the Shanghai International Arbitration Center (SHIAC) since May 2016
Mr. Frédéric Pierucci
Mr. Frédéric Pierucci
Mr Frédéric Pierucci, is a former ALSTOM senior executive with extensive international experience, having lived and worked in China, the United States, Algeria, the United Kingdom, Singapore and in France.
In particular, he was global sales manager for the "Steam Generating Stations" division, in charge of negotiating major international contracts for the supply of turnkey coal-fired power plants and conventional islands of nuclear power plants.
Until mid-2013, he headed the "Chaudières" business (ALSTOM Boilers) in Singapore, representing 1.4 M € turnover and 4,000 employees.
On a US business trip in 2013, he was arrested by the FBI at JFK airport as he was getting off the plane, accused of "participating in alleged corruption." in Indonesia under a contract awarded by ALSTOM in 2003 ".
Having lived "from within" the consequences of anti-corruption laws, first as a former leader of ALSTOM, then as an accused, he is in a unique position to advise companies and their leaders on enforcement issues of the US Foreign Corrupt Practice Act and other similar laws, and the procedures to be put in place to guard against them.

Markus Asshoff advises a wide range of companies in all sectors, including national and international companies, including German groups with interests in France, on all aspects of individual and collective employment law and social security law.
His practice is particularly focused on international employment contracts, managing director’s status, negotiation of termination packages, mobility, complex restructuring operations, including social plans, transfer of business as well as day-to-day advice to HR departments. Moreover, Markus assists his clients before French Labour Courts.
Markus is a member of the TW International Compliance Practice Group and specialises in all notably employment law related issues (employee trainings, alert procedures, audits, etc.).

Mrs. Cara Meng
Cara Meng is a Senior Associate at Taylor Wessing based in Shanghai Office. Cara specializes in advising on compliance matters. Throughout the last 7 years Cara has advised various MNC’s and SME’s from different industries on compliance related matters. This covers both investigation work on complex internal investigations but also setting-up and maintaining compliance management systems for the China operations of foreign invested enterprises. Cara also specializes in general Chinese corporate and commercial law. She advises foreign companies on all aspects of Chinese laws in various industries with regard to their strategy and business in China. Cara’s industrial experience covers in particular the aviation, automobiles, chemical, life science and the general machinery manufacturing sectors.
