Meeting with Shanghai AMR on the 'Shanghai Standardisation Regulations'

To successfully halt counterfeiting in China, it is essential for one to prove that his or her IPR have been infringed, backing by a significant volume of evidence. In Chinese Court the burden of proof lies with the plaintiff. As one proves his ownership via IPR certificates he must also prove the infringement via physical evidence including contracts, photographs of infringing products and proof of sale which have been validated by a notary public.

As a follow-up event of the meeting on the Trademark Law, this meeting aims to explain why the evidence of IPR infringement is important, what can be used and how to effectively secure the evidence needed. The European Chamber is pleased to invite Mr. Lionel Yan and Mr. Benjamin Miles from Blackpeak to share their best practice on evidence notarisation.

On 1st November 2019, China's Ministry of Justice (MOJ) released a draft version of Regulation on the Implementation of Foreign Investment Law. The Draft provides much-needed clarity on certain challenging issues in the Foreign Investment Law (FIL), such as how to reconcile the corporate structure of foreign investment enterprises during the transition period, while leaving certain areas for further clarification. In addition, further ramp up efforts to protection on IP rights, the Draft provides that China establishes the punitive compensation system for intellectual property infringement.
