Legal and HR Working Group Seminar - Update on Draft Labour Contract Law
On December 24, 2006, the Standing Committee of the National People's Congress conducted the second reading of the draft Labour Contract Law. The Standing Committee reviewed a draft prepared by the law committee of the NPC that differed substantially from the first draft that was submitted to the NPC in December 2005.
Among the differences between the two drafts are: adding a provision that fixed-term contracts may be extended only once; restoring termination grounds when employees on fixed-term contracts may be terminated; eliminating restrictions on non-compete covenants; removing the link between job position and permitted length of probation period; and adding new chapters on collective contract and part-time employees.
The law committee will likely make only limited revisions based on feedback obtained from the second reading. The draft law may be further considered and possibly approved at a full session of the NPC in March 2007.
