For more than 30 years, foreign-invested enterprises have flourished with success in China. However, with the constant development and shifts in China’s legal environment, enterprises are now faced with much stricter regulatory requirements. A comprehensive and in-depth understanding of these governing requirements in order to control compliance risks is a vital matter in having secure business operations.
Different types of companies may face varying levels of legal risk, each with different risk priorities. These not only include the traditional risks of bribery, monopoly, financial and tax risks, but have expanded to include intellectual property rights, cybersecurity and data compliance, labor, corporate governance, unfair competition, related party transactions, criminal liability, etc. The personal liabilities of corporate executives are also a topic of great concern to foreign executives in foreign-invested companies.
This seminar will elaborate on these legal risks, unpack their contents and share the methods and precautions for risk prevention and control.
迄今,外商投资企业在华已经蓬勃发展了三十余年。随着中国法治环境的建设和发展,企业今天面对的是一个有法可依且有法必依的环境。全面深入了解这些法律要求,控制合规风险是企业经营中面临的重要课题。
不同类型的企业可能面临的法律风险控制重点不尽相同。传统的贿赂、垄断、财税风险外,知识产权、网络安全和数据合规、劳动用工、公司治理、不正当竞争、关联交易、刑事责任等等都可能或必须成为企业的风险防控关注点。企业高管的个人风险也是外资企业中外国高管非常需要关注的话题。
本次研讨会将为参会者详细梳理这些法律风险,解读其内容并分享风险防控的方法和注意事项。

Members of the Advisory Council may receive complimentary admission to Chamber seminars, conferences and factory visits up to two attendees per event. Additional participants will be charged at the member rate.

Dr. LI Huini, partner of ADAMAS, has extensive experience in legal consultancy services in the foreign investment in China, corporate law, M&A, energy, transportation, high technology, equipment manufacturing and infrastructure construction projects. Her credentials include: assisting a famous French transportation company to participate in several subway and light rail PPP projects; assisting a French pharmaceutical company to complete the restructuring of its Chinese project and the public listing, assisting in the establishment of dozens of Sino-foreign joint ventures in the field of equipment manufacturing and providing daily legal services, assisting in several solar PV projects.
Dr. LI is also very experienced in advising Chinese entities for their investments in France, Germany and Africa. She advised numbers of Chinese SOEs’ and large private enterprises’ outbound investment projects.
In her 15 years career path, she worked at Chinese, German, Swiss law and French firms in Beijing, Shanghai, Zurich and Paris. Mr. Chen graduated from University of Fribourg (BLaw & MLaw) in Switzerland and has a lawyer license issued by the Chinese State. Proficient in Chinese, German and English, he has practicing experience of nearly 14 years, during which he provided legal services in corporate law, mergers and acquisitions, litigation and arbitration for a number of European companies, especially Swiss companies. Meanwhile, as the only lawyer recommended by the Embassy of China in Switzerland and also suggested by the Chinese Chamber of Commerce in Switzerland, he has assisted many Chinese state-owned and private companies in their investments and acquisitions in Switzerland. He has a good knowledge of Europe, especially when it comes to Swiss culture, values and ways of thinking. Through his ability to comparatively read the legal systems of these two countries, his proficiency in multilingualism, and his pragmatic approach to problem- solving, he has brought strong support to his clients both at home and abroad.
