Recently, the State Administration for Taxation (STA) asked input from foreign companies on the updated draft of tax treaty treatment of non-resident taxpayers. With this new draft for this policy the STA attempts to simplify the treaty benefits application information, enable non-resident taxpayers and withholding agents to comply with the rules and help to improve the efficiency of tax filing. This is part of the STA attempt to promote reforms in order to delegate power, streamline administration and optimize government services, and simplify tax procedures.

In a broader scheme these developments are part of the Chinese government’s push towards ending tax avoidance and evasion practices. In the last decade China has put significant steps towards that goal by addressing this issue in multilateral meetings and working towards the OECD/G20 Base Erosion and Profit Sharing (BEPS) program.

In 2006, after ten years in field operations at the Foreign Taxation Office in Wuxi, Mr Feng was selected to work in the headquarters of the STA and spent eight years in international cooperation, tax treaty negotiations and interpretations, non-resident taxation management and outbound taxation monitoring.

Amongst other things, Mr Feng was involved in treaty negotiations or renegotiations with UK, France, Germany, Japan, Mexico, Czech, Mauritius and Barbados. He took an active role in drafting and implementing tax circulars such as circular 698 of 2009 and initialling QFII taxation rules. He gave lectures to local tax officials nationwide and 12366 hotline staff on international taxation issue at several instances. He also participated in OECD meetings in Paris, OECD training courses in Vienna and field trainings on foreign taxation in Canada and Australia. He is listed as team member of the STA BEPS working panel.

During his Deloitte career starting from March 2014, he has successfully assisted their clients in settling many sophisticated and disputable tax issues, especially in international tax field.

He has a US LLM degree in taxation and bears certificates of Chinese Lawyer Qualification, Registered Tax Agent and medium-level Accountant.
