On June 29th the latest draft of amendments to the PRC Individual Income Tax was opened to public consultation revealing potentially impactful changes. Much of the initial headlines on the draft have focussed on the consolidation of various categories of incomeand on the introduction of more itemized deductions. The proposed changes aim to promote social fairness and justice by alleviating the tax burden, increasing personal income, and boosting consumption on the middle and lower income classes.
With respect to European companies, the potentially most significant amendments arethe proposed change to the definition of a tax residentand the introduction of a general anti-avoidance rule (GAAR) for IIT that is intended to close loopholes in the current system.
While this draft may be subject to change, the effects on expatriates/foreigners working in China are potentially profound. All international companies should be actively planning ahead to ensure they are prepared to deal with the consequences of these amendments.
