Background information:
10月8日,商务部发布《外商投资企业设立及变更备案管理暂行办法》(简称《暂行办法》),自发布之日起施行。该《暂行办法》的实施将大幅减少对外国投资者的监管负担,并加快在中国成立外商投资企业的监管注册程序。中国欧盟商会很荣幸的邀请到商务部外国投资管理司产业处处长朱冰,于2016年11月23日就该《暂行办法》进行解读,分析其对在中国的外商投资企业的设立和变更的影响,并与与会者进行沟通交流。
On 8 October 2016, the Ministry of Commerce (MOFCOM) officially released the Interim Measures for the Record-filing Administration of the Incorporation and Change of Foreign-invested Enterprises (hereinafter referred to as “Interim Measures”), which came into effect on the same day they were publicized.
After the introduction of the Interim Measures, substantial examination and approval process required by China's approval authorities (i.e., the Ministry of Commerce or its local counterparts) for the establishment and subsequent changes of foreign-invested enterprises (FIEs) will be simplified to a filing system, as long as the FIEs in question are not engaged in industries included on the national negative list. These legal changes will substantially lessen regulatory burdens on foreign investors and speed up the regulatory registration process for the establishment of FIEs in China.
The European Chamber is pleased to invite you to a session with Zhu Bing, Director of Industry Division, Department of Foreign Investment Administration, MOFCOM. Director Zhu will interpret the newly adopted Interim Measures, analyze their impact on the establishment and changes of FIEs in China and interact with participants at the meeting.
