Under PRC employment laws, a written employment contract is required for the establishment of a full-time employment relationship. What are the mandatory contract provisions, the most critical provisions and terms, and how to set out such terms of the employment contract to mitigate legal risks are vital for in house HR and legal counsel?

It is a common practice that employer sets out its HR related rules and policies in the Employee Handbook. Employee Handbook is very important and can be one of the key evidences in the course of labour dispute for the employer to prove that it has well established complete rules and policies. PwC experts will share with you what provisions a typical employee handbook includes, what are the most critical issues that easily cause labour dispute and how to draft the terms of handbook and make it take effect. In addition, we will also share with you the common China individual income tax planning strategy for locally hired foreigners. This workshop will be finalized with case studies sharing.

Jane Gao is the Senior Manager in charge of employment law practice. Jane is a certified PRC lawyer and have nearly 20 years employment and HR experiences.

In-house Experience:
Jane started her career as an Human Resources Manager for more than 10 years. After being certified as PRC lawyer, Jane worked at multinational companies as in-house Senior Legal Counsel. Jane has gained extensive and practical experience in handling employment and labour issues and HR management. Her cross-functional work experience enables her to provide clients with comprehensive, practical and effective legal services.

Areas of expertise:
Jane is specialized in advising on labour & employment issues in relation to M&A, joint venture partnerships and business closure; mass lay-off; designing compliant HR practices and processes for newly set up business in PRC; immigration issues; employment issues in relation to regulatory and ethic compliance; labour arbitration and litigations; and developing strategies for navigating HR related legal risks in China.

Key experiences:
Jane worked at Motorola as Senior Legal Counsel, Commercial and Employment, providing legal support to China sales and HR team on various legal matters. While working for Motorola, she assisted the company in business closure, sales of manufacturing and various redundancy programs. Before joining PwC, Jane worked for DLA Piper as Senior Associate in the firm’s Employment Practice group, assisting MNCs in labour and employment issues.
