Comments to MPS on the Regulation on Classified Cybersecurity Protection (Draft for Comments)

The European Chamber’s Cybersecurity and other relevant working groups submitted collated comments in response to the Ministry of Public Security's (MPS's) public consultation on the Regulation on Classified Cybersecurity Protection (Draft for Comments).

The European Chamber recognised the importance of the Regulation in implementing the Classified Cybersecurity Protection Scheme introduced by the Cybersecurity Law, and appreciated the removal of equity and intellectual property (IP) restrictions targeting international companies under the existing Administrative Measures on the Classified Protection of Information Systems. It also expressed concerns relating to the Regulation's broad scope of application, extensive security protection obligations and the lack of clarity of certain key provisions. It also hoped that alignment can be ensured between the Regulation and other major Chinese cybersecurity schemes.
