Summary

The European Chamber has heard of cases of stricter enforcement of current visa-related regulations in the time leading up to the implementation of the new Administration Law on Entry and Exit which came into effect 1st July, 2013.

Uncertainties that may lead to overly strict implementation remain as detailed implementing rules are still to be issued. Inconsistent implementation of visa policies and inconsistent visa practices in different regions make business travel planning and expatriate relocation difficult, especially as processing complications and timelines cannot be easily predicted.

This is another example of the unpredictability of the legal system and its implementation having a major impact on foreign businesses. Of those companies participating in the European Chamber’s 2013 Business Confidence Survey, 31 per cent described “visa and work permit practices” to be one of the top regulatory obstacles when doing business in China, which represents an increase on previous years.
