Over the past year, China has introduced a series of new regulations in the area of data security and cross-border data transfer, and made positive exploration in balancing development and security, including but not limited to the Network Data Security Administrative Regulations, the Provisions on Promoting and Regulating Cross-border Data Flows, the respective negative lists or industry-based general data lists of cross-border data in the FTZs of Tianjin, Shanghai, Beijing and other places, as well as sensitive personal information identification and other national standards and guidelines. As the relevant compliance work enters the most difficult stage, it is necessary to summarise the current overall compliance situation and to check and fill in the gaps on the important and difficult points.
过去一年,中国在数据安全和出境领域出台了一系列新规,在平衡发展与安全方面做出了积极探索,包括但不限于《网络数据安全管理条例》,《促进和规范数据跨境流动规定》,天津、上海、北京等地自贸区相继出台的各自数据出境负面清单或基于行业的数据跨境一般数据清单,以及敏感个人信息识别等国家标准和指南。随着相关合规工作进入深水区,有必要对当前整体合规情况进行总结,并就其中重难点查漏补缺。
Looking ahead, work related to data classification and grading continues to advance, and regulations such as personal information compliance audits and cybersecurity incident reporting are still to be released, placing new demands on companies to continue to learn and pay attention. In the face of rapidly developing new technologies and the accompanying regulatory requirements, how to achieve a high level of security while promoting the development of emerging technologies will be a new issue worthy of consideration by all parties.
展望未来,数据分类分级相关工作持续推进,个人信息合规审计、网络安全事件报告等规定仍待发布,对企业提出了持续学习、不断关注的新要求。面对快速发展的新技术以及随之而来的监管要求,如何在促进新兴技术发展的同时实现高水平安全,将是值得各方考虑的新问题。
Against this background, the 2024 Cybersecurity Conference will invite renowned experts, scholars and lawyers in the industry to discuss and exchange views, to sort out the latest regulatory developments in the field of cybersecurity and data protection for European enterprises in China, and to help them better understand the relevant compliance requirements, as well as the future development trend.

Member of China Leadership team, EVP, Head of CX Strategy & Technology, Board Member of Nokia FUNO. He has over 22 years of managerial experience in multinational companies on ICT research & innovation, standardization, technology strategy and regulations and Pre-sales. After joining Nokia, he has assumed various managerial roles in research & standardization, strategy & regulations, Solution Pre-sales/Sales support. He currently looks after all major technologies frontline relevant to Nokia mission and thought leadership in Greater China, e.g. 5G/6G, oRAN/vRAN, critical network evolution, cloud & digital transformation, technology policies for cybersecurity and data security.
Supervisory Board Member of CCSA (China Communication Standard Association). National Chair of ICT working group, EU Chamber of Commerce in China (EUCCC). Michael served as Vice President and Board Member for EUCCC (2017-2019), where he played a leading role in China-EU high level dialogue on High-Tech & Digital policies and cross-industry exchanges. Michael was a member of the “EU-China Expert Group on Digital Economy & Cybersecurity” formed by China & EU government as top dialogue platform on digital policies coordination.

He Yanzhe is the Deputy Director of Evaluation Lab, Cybersecurity Evaluation Centre from the MIIT-affiliated China Electronics Standardisation Institute (CESI). He is involved in the drafting of various Chinese data protection standards and is a regular speaker at influential dialogues on cyber security and data flow security across China.

Zhang Yuxin, researcher of the Industry Promotion Department, China Industrial Control Systems Cyber Emergency Response Team (CICS-CERT), has long supported the CAC and the Ministry of Industry and Information Technology to carry out the work of data security and personal information protection, undertaken more than 10 provincial and ministerial-level projects in the field of data security, and participated in the drafting of regulations and policies and standards such as ‘Regulations on the Administration of Network Data Security’, ‘Guidelines for the Implementation of Standard Contracts for Cross-border Flow of Personal Information in Guangdong, Hong Kong and Macao’, ‘Rules on Data Classification and Grading of Data Security Technology Guiding Opinions on Promoting the Development of Data Security Industry’ and other regulations, policies and standards drafting, as well as research work on national topics such as key technologies for security risk analysis and dynamic assessment of sensitive data outbound, and China's programme for cross-border data flow.
张誉馨,国家工业信息安全发展研究中心产业促进所研究员,长期支撑中央网信办、工信部开展数据安全、个人信息保护等工作,承担数据安全领域10余项省部级课题,参与《网络数据安全管理条例》《粤港澳大湾区个人信息跨境流动标准合同实施指引》《数据安全技术 数据分类分级规则》《关于促进数据安全产业发展的指导意见》等法规政策标准起草工作,以及敏感数据出境安全风险分析与动态评估关键技术、数据跨境流动中国方案等国家级课题研究工作。

Mr. Cai Peng specialises in cybersecurity, data protection and intellectual property rights, covering industries such as TMT, manufacturing, finance and healthcare. Based on his active participation in relevant legislation and practice, Mr. Cai Peng has long been committed to helping clients solve urgent and challenging issues such as data compliance, e-commerce transactions, intellectual property rights and other related issues in the face of strong regulation, IPOs, "going global" of products and services, digital transformation, platform governance and so on. Cai Peng is specialised in solving problems related to internet, e-commerce and intellectual property rights.
Mr. Cai specialises in solving data security risks and compliance challenges arising from the Internet, big data and artificial intelligence technologies, such as corporate cybersecurity risks and data security control, data lifecycle compliance arrangements, identification and control of personal information and privacy risks, cross-border data compliance solutions, design of global data and privacy compliance solutions, data risk incident prevention and response, and data audits. Mr Cai also specialises in the construction and arrangement of transaction models for enterprises in the digital transformation, the risk investigation of the whole transaction process, the construction of e-commerce platforms, the design of compliance and risk control measures in specific Internet scenarios, and the avoidance of compliance risks in online marketing.
Mr Cai Peng has been dealing with technical intellectual property litigation and non-litigation cases for many years, which gives him a valuable perspective and experience in dealing with data compliance and other matters. Mr. Cai Peng has not only helped many IP right holders to solve complex problems in cross-border licensing, domestic IP licensing, supply chain cooperation and other scenarios, but also assisted many domestic and international leading enterprises in transferring and acquiring IP rights through joint ventures, acquisitions, licensing, cross-licensing, etc. He has also assisted many domestic and international leading companies in transferring and acquiring IP rights. Ms. Barbara Li
Barbara is a partner based in Beijing. With almost three decades’ experience working in a senior in-house legal role at the Beijing and London offices of leading international firms, as well as providing business consultancy services at PwC, Barbara brings a wealth of knowledge to advising international and Chinese companies and financial institutions on doing business in China and globally. She focuses her practice on complex, cross-border M&As, joint ventures, strategic alliances and foreign direct investment in a wide range of industries including the high-tech, telecom, energy, infrastructure, automotive, pharma and high-end manufacturing industries. She also counsels Chinese companies on their outbound strategies and major transactions.
Barbara has a particular interest in the cyber, data, technology and FinTech sectors, with significant experience advising international companies and financial institutions on navigating China’s evolving legal regime governing data and cybersecurity. She is regularly engaged by clients to provide legal support on high-stakes data and cybersecurity-related issues including managing complex, cross-border data transfers, the digital transformation of businesses, and the deployment of emerging technologies such as AI, cloud computing and blockchain. Ms. Xiaowen Ma

Ms. Xiaowen Ma
Xiaowen Ma serves as Senior Public Policy Manager for Infineon Technologies. She currently chairs the European Chamber’s Cybersecurity Sub-working Group. Prior to this role, Xiaowen worked as Senior Business Manager at the European Chamber, where she was responsible for the Information and Communication Technology Working Group and the Cybersecurity Sub-working Group, led the Chamber’s engagement with Chinese and European governments and other stakeholders in the ICT field, and provided counselling to European companies on market entry and regulatory issues, especially on cybersecurity, encryption, data protection and telecoms/cloud.
Xiaowen holds a Master’s degree in European Affairs from Sciences Po Paris, and a Bachelor’s degree in French Language and Literature from Renmin University of China.
