Despite presenting serious challenges throughout 2020, COVID-19 has not managed to impact the ineluctable roll-out of new, significant pieces of Cybersecurity implementation rules and draft laws in China. One notable release was the draft Data Security Law in July 2020. China’s determination to more-stringently regulate its cyberspace have been paralleled by a doubling of compliance endeavours from foreign businesses in China, which has increased both the cost and the operational burden of doing business, at least in the short-term.
In order to examine how the Cybersecurity Law and the Data Security Draft Law will coexist, and what the long-term impact will be on European companies operating in China, the European Chamber as assembled a distinguished group of government representatives, lawyers, security experts and industry representatives to discuss this topic at its annual Cybersecurity Conference.

疫情的爆发使2020成为充满挑战的一年,然而这次危机没能阻挡大量网络安全相关新规定、新法规草案的推出,其中就包括了引人注目的《数据安全法(草案)》。在中国立法机构加大对网络空间的监管力度的同时,在华外企也加倍努力遵守规章制度。因此,中国欧盟商会很荣幸能和政府部门代表、律师、安全专家以及各行业代表一道分析《网络安全法》以及《数据安全法(草案)》将如何共存并融入当前商业环境。
This year the Cybersecurity Conference will address the following important questions:
- What should foreign businesses expect from the newly enforced Cybersecurity Review Measures (CSRM)?
- What impact has Cybersecurity implementation had on the China operations of foreign companies so far?
- How to understand data and personal information?
- How to comply with data regulations from a business perspective?
- How are companies being impacted by the uncertainties brought about by the idea of Critical Information Infrastructure, and the strict reviews under the Classified Cybersecurity Protection Scheme (CCPS or MLPS2.0) and the CSRM, and where do we go from here?
- From a business perspective, how can we understand ‘data’ under the different contexts of the draft Data Security Law in China, the General Data Protection Regulation (GDPR) in the European Union and the California Consumer Privacy Act (CCPA) in the United States?

Mr. Nicolas Chapuis

Mr. Nicolas Chapuis
Mr. Chapuis began his career in the 1980s as the Press Attaché at the Embassy of France in Beijing. In 1983, he was appointed Second Secretary (Political Affairs) at the Embassy of France in Beijing and then Desk Officer for China, Taiwan, Hong Kong, and Mongolia at the Asia-Oceania Department of France’s Ministry of Foreign Affairs (MFA). Between 1987 and 1988, he was a CFIA Fellow at Harvard University.
In 1988 and 1989, he held the position of Desk Officer for NATO & European Security at the Political Affairs Department of France’s MFA. From 1989 to 1992, he was the Cultural Counsellor at the Embassy of France in Beijing.
Mr. Chapuis's diplomatic career continued in the role of Deputy Chief of Mission at the Embassy of France in Singapore. Following this, he held the position of Personal Assistant to the Deputy General Secretary for European and Economic Affairs at the MFA before becoming the Deputy Director (East Asia) of the Asia-Oceania Department of the MFA from 1995 to 1998.
In 1998, returned to China as the Consul General in Shanghai. Between 2002 and 2003, he was First Counsellor (Cultural Affairs) at the Embassy of France in the United Kingdom and the Director of Institut français du Royaume-Uni.
From 2003 until 2005 Mr. Chapuis served as Ambassador of France in Mongolia and in 2005–2009 he was Deputy Chief of Mission at the Embassy of France in Beijing.
In 2009–2010, served as Prefect of the département of Hautes-Alpes. Following this, held the position of Chief Coordinator of the MFA WikiLeaks Taskforce until 2011.
Mr. Chapuis has been the Ambassador of France to Canada since February 4th, 2015. In September 2018 was nominated as Head of the EU Delegation to China
Mr. Jörg Wuttke

Mr. Jörg Wuttke
Jörg Wuttke is Vice President and Chief Representative of BASF China, based in Beijing. Since joining BASF in 1997, Mr. Wuttke has been responsible for helping guide the company’s investment strategies for China, negotiation of large projects and government relations.
Previous to joining BASF, Mr. Wuttke worked with ABB for 11 years; in fact his first professional encounter with China was in 1988 as the Finance and Administration Manager of ABB Beijing. In 1990, he returned to Germany as Sales Manager of ABB Power Plants Division, responsible for gas turbine sales to Africa and Russia. In 1993, he became Chief Representative ABB China in Shanghai and in 1994 moved to the President's Office of ABB China in Beijing, where he was responsible for the development and financing of large projects.
From 2001 to 2004 Mr. Wuttke was the Chairman of the German Chamber of Commerce in China. From 2007 to 2010, 2014 to 2017, and since May 2019 again he is the President of the European Union Chamber of Commerce in China
From 2011 to 2019, Mr. Wuttke was Chairman of the BIAC China Task Force of the Business and Industry Advisory Committee to the OECD (BIAC), a Paris based body of major business associations that lobbies the OECD.
From 2013 to 2016, and again since 2019 Mr. Wuttke is Vice Chairman of the CPCIF International Cooperation Committee, a group representing Multinational Companies in China’s Chemical Association.
Since its establishment in 2013, Mr. Wuttke is member of the Advisory Board of Germany’s foremost Think Tank on China, Mercator Institute for China Studies (MERICS), in Berlin.
In January 2019 Mr. Wuttke joined the International Board of the Stars Foundation, in Switzerland. stars - for Leaders of the Next Generation.
Mr. Clas Neumann

Mr. Clas Neumann
Clas Neumann is Global Head of the SAP Labs Network since 2009, and has been leading the Fast Growth Market Strategy team since 2013. In his role as Labs Head, Neumann acts as the central coordinator of all network activities. In his role as Head Fast Growth Market Strategy he leads the investments for SAP’s growth markets in Africa, China, Middle-East and Russia. Neumann has co-authored different books & article son innovation in emerging markets and been recognized through different awards for his engagement in society and business.
Dr. Hong Yanqing

Dr. Hong Yanqing
Dr. Yanqing Hong is Professor in Beijing Institute of Technology. He focuses on data protection, cross-boarder data flow and cybersecurity related legal issues. He now leads the standardization project on personal data protection under the National Information Security Standardization Technical Committee of China, and acts as deputy head of the drafting task force for Guidelines for Data Cross-Border Transfer Security Assessment. He regularly participates in the bilateral or multilateral dialogues on cyber related issues, such as China-EU Digital Economy and Cybersecurity Expert Working Group which is organized by the Cyberspace Administration of China and DG Connect of the EU Commission. He received his Ph.D. in Law from the School of Law, Utrecht University, the Netherlands.
Mr. Chen Jihong

Mr. Chen Jihong
Chen Jihong is a Partner at Zhong Lun Law Firm and is widely regarded as one of the leading cyber security and IP lawyers in the PRC having advised some of the world's largest companies, both foreign and domestic.
Mr Chen’s main areas of legal expertise include: TMT Law, Intellectual property protection, IP portfolio management, IP licensing, e-Commerce, Privacy and data protection, anti-unfair competition, cyber security, domain name dispute resolution, IT and High-tech related legal matters.
Fluent in both Chinese and English, Jihong received his Masters at Tsinghua University in 1996, before graduating from Chicago-Kent College of Law in 2002. Mr Chen is widely published in leading academic journals and has received numerous awards domestically in the areas of IP and telecommunications law, most recently Mr. Chen was selected as “2015 China Top 15 IP Lawyers” by Asia Law and Business and in 2016 was awarded “Telecommunications Law -Lawyer of the Year in China” by Corporate INTL.
Ms. Maggie Yin

Ms. Maggie Yin
Maggie (Pengling) Yin is Data Strategy Officer in China at RELX who is also responsible for government affairs, and data security and privacy protection professional. RELX Group is a global provider of information and analytics for professional and business customers across industries. Maggie used to be working for Ministry of Commerce, has rich experiences on information technology and application as a regulator and policy-maker. She was appointed by Ministry of Commerce to the Chinese Embassy to the Netherland as the second secretary for four years with responsibilities of international trade and investment cooperation.
Mr. Xinjie Wang

Mr. Xinjie Wang
Mr. Wang Xinjie, is the general manager of Beijing Powertime Co., Ltd. He has been engaged in cyber security since 1999 and has specialized in in information security management systems consulting and auditing, Classified Cybersecurity Protection Scheme (CCPS), information system auditing, information security risk management and business continuity management. Since 2002, he has been engaged in the Chinese mirror committee to ISO/IEC JTC1/SC27, SAC/TC 260. As a committee member of TC260, he has been involved in the development of many Chinese information security national standards. He has been honored twice with the prestigious award of Advanced Individual in National Information Security Standardization Work.
He has been actively involved in the work of ISO/IEC JTC1/SC27 since 2007. During this time, he has taken part in all of the working group meetings of WG1 including many of the SC27 Plenary meetings, giving him a broader management perspective of the sub-committee and its technical work.
He established and currently runs the China authorized agency of (ISC)2 the certification body of the CISSP. He is also a member of RAISE (Regional Asia Information Security Exchange Forum) a regional platform for the Asian standardization community. He developed the training courses for ISMS Auditor and CISP-A Information System Auditor, and published the National Certified Information Security Management System Auditor Training Courses and the Guideline on the Implementation of Medicare Industry Information Security Classified Protection, and took a lead in the translation of Handbook for the International Critical Information Infrastructure Protection.
Dr. Wu Shenkuo

Dr. Wu Shenkuo
Law Professor and LLM Tutor of College for Criminal Law Science & Law School at Beijing Normal University. He gets his PhD and Post-doctor at University of Verona. He is also the associate researcher at the University of Verona and contract researcher at the University of Turin, as well as senior consultant of United Nations for cybersecurity and cybercrime issues, consultant at the Supreme Court of China, consultant of Politics and Law Committee of Beijing, Secretary-General of Research Centre of Internet Society of China, editorial board member of authoritative criminal journal Diritto Penale XXI Secolo, consultant of QS Ranking Group for academic reputation of international universities.
Prof. WU is specialized in Cyber Law,ICT Criminal Law (Cybercrime), Economic Criminal Law (White Collar Crime), Comparative Criminal Law and International Criminal Law (European Criminal Law). Prof. WU has already published, in Italian and English, one piece of monograph, two pieces of books in collaboration with his research team, about 10 pieces of articles on the foreign core journals and completed the Italian translations of Chinese Criminal Law, Criminal Procedure Law and Judicial Interpretation of Criminal Law. Besides, Prof. WU has also published more than 10 pieces of articles on CSSCI journals like Tsinghua Law Review and core presses like Guangming Daily. For the research projects, Prof. WU has been in charge of several international academic projects funded by Italian Central Bank, University of Turin, Cariverona Foundation, etc and several national academic projects funded by Chinese National Social Science Funds, China Scholarship Council, Beijing Normal University and so on.
Mr. Bangcai Wu

Mr. Bangcai Wu
Mr. Wu is an expert in the field of information security with more than 10 years of professional experience. He had worked as security product manager, information security consultant, specialist in information security solutions, and other positions. Provided security product implementation, information security management system construction, overall planning of information security, and security operation center construction to more than 30 important customs, Mr. Wu has accumulated abundant experience in the field of information security management system and security technology.
Before joining BSI consultant and training industries, Mr. Wu was a solution expert in a national-leading big data Network Security Situation Awareness (NSSA) company. He has a deep understanding of connections among big data, cloud computing, and information security as well as their application in the field of information security. He is also experienced in the security operation center’s construction of security management system and SIEM system.
Mr. Bruce Fu

Mr. Bruce Fu
Bruce Fu is a senior director and the co-lead of the global tech practice in APCO Worldwide's offices based in Beijing. He has a deep knowledge of China’s policy, technical standards, IPR, and competition-related issues in the ICT sector. At APCO, Mr. Fu provides clients with counsel on government relations building, operations management, stakeholder engagement and market entry strategy.
Prior to joining APCO, Mr. Fu was a business manager at the European Chamber, where he worked closely with the European telecommunications industry by lobbying China’s telecommunications policies and regulations. He worked closely with ICT Working Group members on telecommunications regulatory policies and TBT/Standards. He also directly engaged with Chinese authorities on antitrust issues related to implementing rules of Chinese anti-monopoly law.
Mr. Fu currently serves as the Vice Chair of the ICT Working Group of the EU Chamber of Commerce in China. He obtained master's degrees in European studies and European modern history from the Catholic University of Leuven. He is fluent in English and Chinese and speaks intermediate French.
Ms. Caroline Chen

Ms. Caroline Chen
Caroline Chen is the Head of Business Development in Deutsche Telekom Representative Office Beijing. She leads the local BD Team, in charge of regulation tracking, partnering development, standardization coordination and innovation scouting for Deutsche Telekom group units. She has been with Deutsche Telekom starting from 2012.
In addition to the work at Deutsche Telekom, Caroline Chen has been actively engaged in European Chamber and has been elected for the Vice Chair and then the Chair of ICT working group in the past several years. As one of the leading pens for the ICT position paper, she contributed substantially to the key recommendations writing and editing. She also initiated and actively participated at the dialogues between governmental bodies and ICT working group in order to promote the common interests of European industry in China.
Prior to joining DT, Caroline Chen was an analyst in an American consulting firm Marbridge Consulting, where she worked mainly for clients including European telecom companies and American venture capitals & PEs for understanding the Chinese telecom and internet industries.
Caroline Chen was graduated from Central University of Finance & Economics with a Master Degree in Economics, and from Beijing Foreign Studies University with a Bachelor Degree in English Literature.
Dr. Renhai Gong

Dr. Renhai Gong
Dr. GONG Renhai, Director of Policy Research, SAP Greater China, who also serves as the National Chair of Cybers-security Sub-working Group under EUCCC. He mainly focuses on tracking legal and practical research on Cybersecurity Law, Cryptography Law and other related digital economic laws and regulations, Foreign Investment Law, Autonomous and Controllable Policy. Dr. Gong has been working in central government agencies for near two decades, who was mainly engaged in the WTO Rules Negotiations in Doha Round, consultations of bilateral free trade areas, competition law, trade remedy law and IPR border enforcement. His diplomatic mission lasted for three and half years in the Chinese Embassy in Washington D.C., whose responsibilities were to deal with trade frictions and to study IPR legislation and judicature.
In 2002, he was awarded Master of Arts degree (High Distinguished) in International Relations in Economy and Trade from Flinders University of South Australia. In 2014, Renhai got Ph.D. degree (cum laude) in the major of International Economic Law in China University of Political Science and Law (CUPL). In addition, he was nominated as a senior fellow in the Faculty of Law at the University of Hong Kong (HKU) under Swire Group Scholarship Award.
