10月27日,上海市十五届人大常委会第二十六次会议表决通过了《上海市反不正当竞争条例》(以下简称“《条例》”)并将于明年1月1日施行。本次通过的《条例》将上位法修订后的相关规定以及实践中总结的诸多新业态及问题纳入其中,在《反不正当竞争法》的框架内做了很多细化,但其中仍有某些界定较为模糊,增加了企业面临监管的合规压力。

中国欧盟商会有幸请到上海市人大常委会法制工作委员会两位老师莅临商会为会员公司深度解读《上海反不正当竞争条例》的立法思路,并解答会员针对该《条例》的疑问与顾虑。现诚邀企业报名参加,本次讲座向中国欧盟商会会员免费开放。

A new co-mediation system to settle disputes between Chinese and European Union companies regarding intellectual property matters came into effect in the beginning of July. Centering on trademarks and design, the mechanism was inaugurated by the Shanghai Commercial Mediation Centre (SCMC) and the Boards of Appeal of European Union Intellectual Property Office (EUIPO BoA).

This working group meeting will feature Shanghai Intellectual Property Administration official Peng ZHAO as well as senior representatives of the SCMC who were part of the negotiation, David Chen (Vice Chairman of SCMC) and Dr Zhenyuan HU (Partner of Fangda Law Firm, former Deputy Chief Judge of the IP Tribunal and the Financial Tribunal in an Intermediate Court).

On 28th May, the Third Session of the 13th National People’s Congress adopted the Civil Code of the People’s Republic of China (Civil Code), which is a new chapter of privacy and personal information protection. Recently, the Standing Committee of the National People's Congress initiated the public consultation on the Data Security Law (Draft). 2020年5月28日,第十三届全国人大三次会议通过了《中华人民共和国民法典》(下称“《民法典》”),开启了隐私权及个人信息保护的新篇章。此外,近期全国人大常委会开始征求公众针对《数据安全法(征求意见稿)》的意见反馈。在此,商会诚邀您参加《民法典》个人信息保护条款与《数据安全法(征求意见稿)》实务解读主题会,主讲人为中伦律师事务所合伙人陈际红律师,会议将于八月十四日下午三点到四点半进行。

In a much-anticipated announcement, the National People's Congress released for public consultation on 3rd July the second draft amendments to the Patent Law. Significant changes include the introduction of a Patent Linkage system and a Supplemental Protection Period. These issues have long been discussed but there had been no further information released since the Supplemental Protection Period had been included in the previous draft on 4th January 2019.

The draft amendments to the Patent Law are open for public opinion until 16th August 2020. If you would like to send in comments through the chamber, please kindly submit your comments to sthe@europeanchamber.com.cn by 7th August.

On 1st June the long-expected Civil Code is published at the third session of the 13th National People's Congress. The new code is an amalgamation of existing civil laws and sprawls across seven chapters and 1,260 articles. It is the first time the People’s Republic of China has codified its legal system.

The Civil Code will take effect on 1 January 2021, and when it takes effect, it will abolish, among other laws, the General Provisions of the PRC Civil Law, the PRC Marriage Law, the PRC Guarantee Law, the PRC Contract Law, the PRC Property Law and the PRC Tort Liability Law.

The European Chamber is delighted to announce its series of upcoming working group meetings and events on the Civil Code. Starting off, we are pleased to invite Mr Feng Jing who will introduce our member changes regarding the Contract Law which may dramatically impact a company’s daily operation.

In today's technology-rich environment, companies increasingly get involved in technology licensing and recognize the value of data as a business asset that should be protected and can be exploited through licensing to other parties for more synergy.

Companies therefore can encounter a range of agreements that implicate the protection and treatment of technology, data and related intellectual property (IP) rights. Where one party is seeking to exploit a software, a data feed or has developed a database it wishes to license, data and IP issues may be the specific focus of a transaction. However, those issues also arise as an ancillary consideration in other licenses and commercial transactions, e.g. technology services arrangements or as capital contribution for joint ventures.
