Applying Contract Avoidance of CISG in International Trade

In international trade, when a party commits a serious breach of contract, the United Nations Convention on Contracts for the International Sale of Goods (CISG, hereinafter the Convention) provides a unique remedial mechanism for the injured partyavoidance of the contract. This mechanism is functionally similar to the termination of the contract under the Civil Code of the Peoples Republic of China(hereinafter the Civil Code). This article aims to clarify the key issues and considerations in applying the Conventions avoidance rule within the Chinese legal context, through a comparative analysis of its legal consequences.
