As part of its 30/60 carbon neutrality goals, China set a goal for renewable energy to exceed fossil fuel capacity by 2025. Additionally, China’s Green Energy Certificate (GEC) scheme is set to enter a new stage, with it becoming the sole instrument to track renewable energy consumption in China. Alongside this, China is taking firm steps towards standardising business carbon practices. The country's top economic planner, the National Development and Reform Commission (NDRC), has announced that the country will speed up the establishment of a product carbon footprint (PCF) system.

The fifth episode of the Interpreting the EU's Toolbox series will focus on EU's Corporate Sustainability Due Diligence Directive (CSDDD), which was given a green light by both the European Parliament and the Council of the EU in April and May 2024 respectively. On Thursday 20th June at 15:30, representatives of DG JUST at the European Commission will provide an online overview of the CSDDD, which will be followed by a presentation by Herbert Smith Freehills Partner Antony Crockett on how to approach compliance with this regulation in China.

According to the UN International Trade Centre, SMEs represent 95% of firms in the world and provide 70% of employment opportunities. Data from the OECD indicates that SMEs in China contribute significantly to the country’s various economic sectors. However, SMEs face significant challenges in adopting sustainable practices and operations. In 2018, the Chinese National Environment Ministry reported penalties for environmental regulations violations as mostly incurred by SMEs.

2023年12月29日,全国人大公布了新修订的《公司法》,自2024年7月1日起施行。新修订的《公司法》对公司董事、监事、高级管理人员的责任进一步明确和细化,其中第188条成为追究董监高履职不当责任的重要法律依据。本次讲座的目的是以法律视角解读董监高责任。第一部分是通过对董监高EHS领域法律责任的分析,帮助董监高合规履职,避免被索赔的风险,第二部分是通过董监高责任保险的重点条款分析,帮助企业合理运用董监高责任保险,分散公司以及董事、监事、高级管理人员的被索赔风险。
On 29 December 2023, the National People’s Congress announced the newly revised Company Law which will take effect from 1 July 2024. The revised Company Law further clarifies and elaborates on the responsibilities of company directors, supervisors, and senior executives, of which the Article 188 has become an important legal basis for holding them accountable for improper performance of their duties. The purpose of this seminar is to interpret senior executive’s lability from legal perspective. The first part will analyze the legal responsibilities of directors, supervisors, and senior executives in the EHS field, help them fulfill their compliance obligations while avoid potential claims. The second part will interpret the important provisions of director and officer liability insurance, guide enterprise to effectively use appropriate insurance instruments to mitigate potential risk of claim against both the enterprise and its directors, supervisors, and senior executives.
