After 12 years’ waiting, the 4th version of the Patent Law with an aim of further motivating innovations and improving the mechanism for cracking down patent infringements was finally passed on October 17, 2020. The amended Chinese patent law will take effect on June 1, 2021. Second Amendments introduced pharmaceutical patent-term extensions and established an early pharmaceutical patent-dispute resolution mechanism and patent linkage system that further protects the rights of patentees.

The global pandemic has further accelerated the digital transformation of businesses resulting in increased reliance on e-commerce platforms, boom in the AI-related industries and digitalisation of production and delivery processes. Intellectual property (IP) is crucial to digital economy as it drives innovation and provides SMEs with comparative advantage over competitors. While digital economy brings about new IP risks like online infringements, it also creates new solutions for IP protection such as the use of blockchain technologies or reliance on sophisticated notice and take-down systems on e-commerce platforms or even the use of internet courts speeding up IP enforcement procedures.
