As stipulated by the Foreign Investment Law (FIL), the state shall establish a foreign investment information report system, and foreign investors or foreign-invested enterprises shall submit investment information to the competent commercial authorities. In order to ensure smooth implementation of FIL, and make proper management of foreign investment and facilitate foreign investors and foreign-invested enterprises (FIEs) to fulfill information reporting obligations, the Ministry of Commerce (MOFCOM), together with the State Administration of Market Regulation, drafted the Provisions on Foreign Investment Information Report (Provisions). At the same time, MOFCOM drew up the Notice on Matters Related to the Report on Foreign Investment Information (Notice) as the supplementary measures for the Provisions, specifying items related to the submission of the required information, and announced the initial, change information and annual reports of foreign direct investment. MOFCOM has released the two documents for public consultations.
《外商投资法》规定国家建立外商投资信息报告制度，外国投资者或者外商投资企业应向商务主管部门报送投资信息。为确保法律衔接顺畅，做好外商投资管理，便利外国投资者和外商投资企业履行信息报告义务，商务部会同市场监管总局起草了《外商投资信息报告办法（征求意见稿）》（下称“办法”）。同时，为保障办法的顺利实施，商务部起草了《关于外商投资信息报告有关事项的公告》（下称“公告”），对外国投资者和外商投资企业报送投资信息的具体事项进行了明确，并公布了外商直接投资信息报告的初始、变更和年度报告表。商务部已公布上述两份文件，并公开征求意见。
