On March 22, 2024, the Cyberspace Administration of China released the Regulations on Promoting and Regulating Cross-Border Data Flow, which further clarified the implementation and articulation of existing cross-border data systems. The new Regulations specify scenarios that are exempt from compliance supervision for data exports, raise the thresholds for data export security assessments and the recordation of standard contracts, and propose rules for implementing a “negative list/white lists” mechanism for outbound data in pilot free trade zones. The Chinese government also simultaneously implemented the Data Export Assessment Measures (Second Edition) and the Personal Information Export Standard Contract Measures (Second Edition).
Recently, on September 24, 2024, the Regulations on Network Data Security were officially announced and are set to be formally implemented starting in 2025. The regulations aim to further standardise network data processing activities, ensure network data security, and promote the lawful, rational, and effective use of network data. The regulations provide further stipulations and elaborations on personal information protection, critical data security, and the cross-border security management of network data.
To assist members in navigating and understanding the regulations on data transmission in both the EU and China, the European Chamber invite experts from Standards and Conformity Assessment (SCA) Forum and Small and Medium-Sized Enterprises (SME) Forum to this seminar to introduce and share the requirements, technologies, and latest practical experiences related to cross-border data transfer and compliances.
