2022年,我国有关部门持续推进出口管制相关立法工作。2022年12月30日,商务部会同科技部等部门对《中国禁止出口限制出口技术目录》(简称《目录》)做出修订,拟将稀土、集成电路、光伏硅片、电子器件、激光雷达等原材料或技术列入禁止或限制出口的范畴。
此次调整将带来哪些管理新规?将会如何影响相关行业?企业将如何调整自身合规体系,实现跨境合规管理?
为帮助会员企业更好地理解我国出口管制制度立法进展、《目录》主要调整内容,建立企业跨境合规管理体制,中国欧盟商会将邀请环球律师事务所合伙人任清,毕马威中国税务合伙人张浩炜就相关内容进行解读、分享。

The Chinese Government has continued its legislative efforts in terms of export control over the past year. On 30th December 2022, the Ministry of Commerce, the Ministry of Science and Technology, and several other relevant authorities jointly announced a series of amendments to the Catalogue of China’s Prohibited and Restricted Technology Export (Catalogue), proposing that certain raw materials or technologies—namely rare earths, integrated circuits, photovoltaic silicon wafers, electronic devices and laser radar—be included in the scope of export prohibition or restriction.
What new regulations will be brought about as a result of these amendments? How will relevant industries be impacted and how should enterprises adjust their compliance mechanism for cross-border compliance management?
To help member companies follow developments in China’s export control legislation and the main adjustments to the Catalogue, thereby enabling them to establish a cross-border compliance management system, the European Chamber is delighted to invite Mr REN Qing, partner at Global Law Office, and Mr Harry ZHANG, tax partner at KPMG China to share their insights on these topics and more.

任清律师是环球律师事务所常驻北京的合伙人,连续多年被《钱伯斯杂志》(Chambers & Partners)、《法律五百强》(The Legal 500)推荐为国际贸易领域的领先律师,并入围《亚洲律师》评选的“年度国际贸易律师”。
任律师是国家商务部律师库入库律师、中国贸促会中美经贸摩擦应对法律顾问、中国法学会WTO法研究会常务理事,在出口管制、经济制裁、WTO争端解决、贸易政策咨询等领域具有丰富的实务经验,为国家商务部、国务院国资委、中国贸促会及银行、保险、石油、化工、军工、航空航天、通信设备、半导体、人工智能、汽车、机床、工程、船运、港口等行业的国内外领军企业提供贸易法律服务。任律师全程参与了美国301调查应对工作,并五次赴美出席听证会。任律师应主管部门邀请参与了《出口管制法(草案)》的论证。
任律师被聘为中国国际经济贸易仲裁委员会、中国海事仲裁委员会、北京仲裁委员会、上海国际经济贸易仲裁委员会、深圳国际仲裁院、重庆仲裁委员会仲裁员,审理或代理了大量仲裁案件。任律师还代理了三起投资者与东道国政府之间的投资条约仲裁案件。
在律师执业前,任律师在国家商务部条约法律司任副处长,从事贸易法律工作。
Mr Qing Ren is the partner of Global Law Firm based in Beijing. He has been recommended by Chambers & Partners and The Legal 500 as a leading lawyer in the field of international trade for years, shortlisted "International Trade Lawyer of the Year" by "Asian Lawyer".
He is one of the Ministry of Commerce's lawyers' bank, China Council for the Promotion of International Trade, China-US Economic and Trade Friction Response Legal Counsel, and Standing Director of the WTO Law Research Institute of the Chinese Law Society.
He has rich experience in export control, economic sanctions, WTO dispute settlement, trade policy consultation and others. His clients in this area include MOFCOM, SASAC, CCOIC, as well as leading domestic and foreign companies in the banking, automotive, machine tool, semiconductor, ICT, aerospace, defence, AI, energy, port and other sectors. As legal advisor to the CCOIC, Mr Ren participated in USTR’s 301 investigation against China and USTR’s 2018 special 301 reviews. He has been invited by the competent authorities to discuss the Export Control Law (Draft).
He is an arbitrator of China International Economic and Trade Arbitration Commission, China Maritime Arbitration Commission, Beijing Arbitration Commission, Shanghai International Economic and Trade Arbitration Commission, Shenzhen Court of International Arbitration Chongqing Arbitration Commission. He has represented many arbitration cases and three investment treaty arbitration cases between investors and governments.
Before practising as a lawyer, he served as the deputy director of the Treaty and Law Department of the Ministry of Commerce, engaged in trade law work.

张浩炜先生拥有华南理工大学法律学士学位和中欧国际商学院的全球高级工商管理硕士,在国际贸易领域已经工作了超过二十年。在以海关法制处副科长的身份从中国海关离职后,张浩炜先生已经在咨询行业从业超过十四年,并协助许多客户共同处理国际贸易和海关相关事务。
张浩炜先生在国际贸易领域拥有多年的丰富从业经验,曾任职于中国海关、四大会计事务所和律所。其深耕于贸易与海关服务领域多年,并谙习中国大陆及香港地区的贸易及海关服务相关的咨询业务。
张浩炜先生曾于一间拥有四十年专注国际贸易与海关业务的美国律所任职大中国区负责人的身份。其建立和对于法律和实操业务十分突出的业务能力。服务的行业范围包括汽车,医药,化工,食品,电子/电气,奢侈品等。
Harry has spent 20+ year in Trade and Customs area, he started his consulting experience since 2008 after he left China Customs as a deputy section chief of legal affair department. In the past 14+ years, Harry has served many clients in Customs and trade related matters.
Harry has been in the trade and customs fields for many years. Harry has vast experiences in local government authority and big 4 firm, as well as rich experiences in building up the customs and trade related consultancy business in mainland China and Hongkong. Harry has been with a US law firm specialized in trade and Customs area for 40 years, as the greater China practice leader. He built up strong and massive legal sense and relevant practical experience with various industries, including auto, medical, chemical, foods and beverage, electrical/electronic, luxury products etc.
Ms. Ziting ZHANG
Ms. Ziting ZHANG
Ziting joined the European Union Chamber of Commerce in China in 2009, currently based in Beijing. She has been responsible for Chamber general government affairs strategy since late 2018. Meanwhile, she is managing the Cheese Industry Desk, the Food for Special Medical Advisory Committee and the Paediatric Nutrition (PN) Desk. In these roles, she is in charge of the daily operations of the industry initiatives and working closely with member companies on the design and implementation of strategies and plans for all three industry initiatives. The core of her work focusses on advocacy on behalf of these industries, including monitoring relevant policies and regulations, coordinating action among international and domestic stakeholders and maintaining external relationships with key industry players, organisations and institutions, and government authorities.
Prior to joining the European Chamber, Ziting worked for Deutsche Welle, the German international broadcaster in Berlin.
