On April 23, 2019, revisions to China’s Trademark Law were passed into law by the National People’s Congress Standing Committee. The amendment aims to enhance intellectual property protection and would seem to be part of a wider effort to address the foreign business community’s concerns over forced technology transfer and IP theft. In another noticeable takeaway the amendment specifically seeks to penalize “bad-faith trademark registrations without intent to use”, another long term complaint from business.
The amendment to the Trademark Law will take effect on November 1, 2019. Together with other pending legislative changes, such as the patent law and the creation of new IP courts, a picture can be painted of a gradually evolving IP legislative landscape. This has not gone unnoticed by European business who reported an improvement in the enforcement of China’s IPR laws and regulations in the Chamber’s recently published Business Confidence Survey.
The European Chamber welcomes Ms. Ling Zhao, Deputy Director of International Trademark Department, CCPIT Patent and Trademark Law Office and Ms. Hatty Cui, Head of Trademark Group, Rouse to analyze these amendments and to discuss how these changes may affect European businesses in China.
