Globally, intellectual property (IP) is a forceful tool to foster innovation and competition. However, there have also been monopoly practices by IP owners to exclude or restrict competition. In June 2022, China’s State Administration of Market Regulation (SAMR) called for public consultation on the Provisions on Prohibition of Abuse of Intellectual Property Rights to Exclude or Restrict Competition (《禁止滥用知识产权排除、限制竞争行为（征求意见稿）》) .

The European Chamber IPR Working Group cordially invites you to the Working Group Meeting: IP & competition: Interpretation of the draft Provisions on Prohibition of Abuse of Intellectual Property Rights to Exclude or Restrict Competition and latest updates from China, to be held on 11^th October, 14.00 – 16.00, at European Chamber Shanghai Office and online.

We are honoured to have Mr Michael Shu, partner at Zhong Lun Law Firm, to share his insights. Mr Shu is a partner of Zhong Lun’s Intellectual Property Practice Group and has over 20 years of experience. Prior to practicing Law, Mr Shu worked for the Chinese government for 7 years. Mr Felix Koo, Vice President of Business Division Automotive Aftermarket, Schaeffler Greater China, will give comments following Mr Shu's presentation.

The WG meeting language will be either English or Chinese, depending on attendee composition. Speakers and moderator will be onsite. We encourage members to attend onsite to take this opportunity to interact with the speakers and fellow members.

Mr Michael Shu （舒海）is the partner of Intellectual Property Practice Group at Zhong Lun Law Firm. Michael is a business-oriented attorney with extensive experience gained from counseling top brands on intellectual property (“IP”), corporate
legal affairs and legal compliance matters, etc. Michael’s practice covers a broad range of industries, including consumer products, high-technology, software, internet, luxury, trading and automobiles.

During his legal practice for over 20 years, Michael has handled numerous IP transaction matters, such as transferring and licensing in relation to trademarks, patents and know-how, etc., and participated in several complicated corporate projects involving IP. Michael has also successfully provided effective consultations and legal services on IP protection strategy for famous brands, such as infringement investigations, negotiations, administrative investigation, civil actions, and pursuit of criminal liabilities.

Michael’s extensive experience as general counsel for over 12 years in foreign invested companies enables him to effectively deal with corporate legal affairs and legal compliance. He currently serves as legal counsel for several domestic and foreign reputable brands on retainer basis. Michael’s 7-year work experience with China government enables him to successfully partner with business clients on government relations (GR) matters. Michael has been representing many foreign brands on compliance matters, government inspections, and consumer complaints, etc.

Felix Koo has over 20 years’ experience in China’s automotive OE and aftermarket business. He helped establishing an automotive wear parts national aftermarket network when he was the Director of Sales and Marketing Gates Units China. After that, he led China’s first distribution network consolidation-United Auto Parts, where he served as a member of board and Executive President. He joined Schaeffler Automotive Aftermarket since 2020 and delivered significant business growth in past 10 years.
