On 4 November the Anti-unfair Competition Law of the P. R. China was adopted after a third reading at the bimonthly session of the Standing Committee of the National People's Congress (NPC). The revised Law will come into force on 1 January, 2018.
The revision redefines unfair competition as that which "violates this law, disturbs market order or infringes on the rights and interests of other operators or consumers during production and operations."
The existing Law took effect in 1993 and the revised Law aims at better addressing new problems emerging in the market, and protecting the rights and interests of both business operators and consumers.
The European Chamber is pleased to invite you to an Exclusive Dialogue with Mr Yang Hongcan, Director General, Antimonopoly and Anti-unfair Competition Enforcement Bureau of State Administration of Industry & Commerce (SAIC), to interpret the revised Anti-unfair Competition Law. DG Yang’s Bureau formulates specific antimonopoly and anti-unfair competition measures, carry out antimonopoly enforcement and initiate investigations into unfair competition practices, commercial bribery, smuggling, and other cases violating economic laws, and supervise the handling of serious and/or material cases.
At the Exclusive Dialogue, DG Yang will talk about the highlights of the revised Law and how the Law will be implemented. He will interact with participants about the Law after his presentation.
2017年11月4日下午，十二届全国人大常委会第三十次会议表决通过了新修订的《反不正当竞争法》。新修订的《反不正当竞争法》将于2018年1月1日起开始施行。
修订后的《反不正当竞争法》将“违反本法、扰乱市场秩序，或在生产经营活动中侵害其他经营者或消费者的权益”的行为视为不正当竞争。现行法律于1993生效，修订后的《反不正当竞争法》旨在更好地处理市场上出现的新问题，保护经营者和消费者的权益。
中国欧盟商会非常荣幸邀请到工商总局反垄断与反不正当竞争执法局局长杨红灿先生，解读修订后的《反不正当竞争法》。杨局长领导的反垄断与反不正当竞争执法局负责拟订有关反垄断、反不正当竞争的具体措施、办法。承担有关反垄断执法工作，查处市场中的不正当竞争、商业贿赂、走私贩私及其他经济违法案件，督查督办大案要案和典型案件。
在本次独家对话中，杨局长将解读修订后的《反不正当竞争法》的亮点以及工商和市场监管部门如何贯彻落实该法。发言结束后，杨局长也将与参会者在问答环节进行互动。
