According to the PRC Disabled Persons Security Law, which became effective on 1st July, 2008, enterprises are obliged to hire disabled persons as a specified ratio of their total staff.

In order to strengthen implementation of the PRC Disabled Persons Security Law, on 9th September, 2015, the Ministry of Finance, the State Tax Bureau and the China Disabled Persons Federation jointly issued the Methods on Levying, Use and Management of Disabled Persons’ Employment Security Fund (Methods‌). The Methods stipulate that all enterprises in China must make contributions to the Fund if they do not hire a sufficient number of disabled persons.

The most impactful element of the legislation change is that The Methods require that individual companies’ average annual salary is used in the calculation of the payable amount instead of using the local average. This has meant a significant increase in contribution requirement for companies hiring a highly skilled or technical work force.

The European Chamber is delighted to welcome Jeanette Yu, Counsel and Head of Employment & Pensions Practice Area Group, CMS, China, to outline companies’ legal obligation in respect to this matter.

In order to promote sharing of best practice and allow for a practical discussion on the implications for business of the new methods of calculation, this event will follow a roundtable format. As such seating is limited.

Jeanette Yu is Partner and head of Employment & Pensions Practice Area Group of CMS, China. She has more than 20 years’ experience in providing advice for international companies on labour law issues and compliance management. Her extensive track record comprises recruitment and dismissal of employees, formulating employee handbooks and implementing its policies, work permits and visa issues of expatriates, international secondment, data privacy, non-competition, social security, trade union and labour disputes. She has also been involved in significant projects of business transactions and restructuring, advising clients on employee transfer, relocation and lay-off of employees as well as negotiation of employment contracts and separation agreements.
Since 2017, Jeanette has been acting as the National Chair/Vice Chair of HR Working Group of European Chamber of Commerce in China. This year Jeanette was elected as the National Chair of HR Working Group of European Chamber of Commerce in China.
Starting from 2017, Jeanette acted as the Vice Chair of HR Working Group of European Chamber of Commerce in China, and the Chair in 2019. Jeanette is also a member of Shanghai Law Society Labour and Social Security Law Research Branch.
