European Chamber Comments on Regulation on Consumer Product Recalls

1.      General Comments/总体评价

The European Chamber welcomes the General Administration of Quality Supervision, Inspection and Quarantine (AQSIQ)’s decision to draft relevant regulations in order to achieve a well regulated market, higher product quality, enhanced responsibility of manufacturers and better consumer protection.

欧盟商会欢迎总局制定相关管理规定，规范市场，提高产品质量，强化生产者责任，保护消费者利益。

Generally speaking, this Regulation expanded the concept of recall in an attempt to include all measures aiming to eliminate defects and reduce or eliminate relevant risks into its scope. This will result in excessive recalls.

总体的问题是本管理办法放大了召回的概念，并试图把所有消除缺陷或降低、消除相关风险的活动都纳入管理范围。这可能导致过度召回。

The dangerous level of product defects are determined by many factors, including type of defects, product attributes, distribution/quantity, as well as conditions of use. The dangerous level of defects shall be scientifically defined, leaving the focus of recall measures on product with highly dangerous defects. This can help increase management efficiency and effectiveness, and reduce management and social costs.

产品缺陷的危害程度由许多因素决定，例如缺陷类型、产品属性、分布数量及使用状态等。应对缺陷危害进行科学分级，并将召回管理的重心放在危害等级高的产品缺陷上。这对提高管理效率、管理效果、降低管理成本、社会成本都是有利的。

More detailed assessment criteria and implementation rules and guidelines are needed to better regulate the implementation process. The European Chamber hopes for a more transparent drafting process, in which enterprises, associations and chambers of commerce are allowed to participate.

需要更详细的实施细则、评价原则、施行指南来规范实施环节。希望这些细则的制定能更加公开透明，并允许企业、协会、商会参与制定的过程。

The European Chamber suggest to introduce a simplified recall procedure. If the recall is initiated by the manufacturer, the products do not need to go through investigation analyses.

欧盟商会建议引入召回简易流程。当生产者主动申请召回消费品时，产品无需经过检验环节即可实施召回程序。

The European Chamber suggest to clarify the termination of the recall. When there cease to be any defects and potential dangers to the consumers, the relevant QSIQ department shall announce within three days the termination of the recall.

欧盟商会建议确定召回终结的期限。即当产品已经确定不存在缺陷时，质检部门应当在3日内公布终结召回程序。
