Comments to China National Intellectual Property Administration (CNIPA) on the Judgement Standards for Trademark Violations (Draft for Comments)

Both industry and law firm member companies commented and offered detailed suggestions to amend the Judgement Standards in ways that best serve members' interests.

Overall, the Judgement Standards for General Violations of Trademark have been refined to facilitate law enforcement. However, some exceptions need to be madeto avoid the expansion of law enforcement. The Judgement Standards should also be harmonised with the Standards for Trademark Examination and Trial, which the European Chamber also submitted comments on in July 2021.
