Submitted comments on the Draft Revision of the Product Quality Law to SAMR

Based on group discussion and an in-depth evaluation of the text of the Revision Draft of the Product Quality Law, the Chamber collated the comments and suggestions received from members on the draft and submitted it to Department of Product Quality Safety Supervision of State Administration for Market Regulation (SAMR). 

Since the formal launch of the amendment of the Product Quality Law in 2019, the European Chamber has maintained a high level of attention to the revision of the Law. China’s increased economic strength, improved living standards of its people and rapid market innovation has made this revision an imperative. When comparing foreign and domestic administrative priorities and practices related to product quality, it is clear that the European Union (EU), the United States and other developed countries put more focus on safety-related standards, while China’s current Product Law applies the abstract term of ‘unqualified products’, which mixes unsafe and substandard issues. Additionally, this approach leads to supervisory resources being occupied with monitoring sub-standard products, which ultimately does not protect consumer safety.

In the comments, shifting administration focus on product safety is highlighted and differentiation of safety issue and non-safety related issue (fail to comply with the declared recommended standards) in terms of penalty is suggested.
