On 26 November 2013, after lengthy negotiations, France and China officially signed a new Double Taxation Agreement. This new Treaty intend to replace the former Double Taxation Agreement of 30 May 1984. While the ratification process is ongoing in both countries and this new agreement is expected to be implemented at the beginning of 2015.
This very much needed update will impact several French / European companies and individuals in their day-today business activities between France and China. It will have very practical consequences for companies as it reforms the existing tax rate on dividends, the creation of Permanent Establishment and contains additional provisions to deny preferential withholding tax rates on dividends, royalties and interest, and the application of the domestic anti-avoidance rules.
Our keynote speakers Mr. Jildaz ECOLAN, Counsellor Fiscal Affairs at the French Embassy in China, and Ms. GUO Min, Partner at Gide Loyrette Nouel, will present together the implications for the business community behind this Double Taxation Agreement that could be a basis for future similar agreements with other European countries.
