On October 1, 2016, the revised Equity Joint Venture Law, Contractual Joint Venture Law and Wholly Foreign Owned Enterprise Law will enter into effect. They shall be supplemented by the first nationwide “Negative List” as well as by the Interim Measures on Filing System for Establishment and Change of Foreign-Investment Enterprises (“FIEs”) to be promulgated by MOFCOM. If implemented as expected, the new laws will substantially change the current administrative processes for FIEs, the sequence of involved governmental authorities and other relevant aspects. Affected are not only new establishments, but also the administration of changes to existing FIEs (e.g. changed company name, legal representative, business scope, organization scope, foreign investor), capital increases, equity transfers and pledges, company mergers, splits and terminations. The speakers will explain these developments including its impact on your business.
