On 22nd March, 2024, the Cyberspace Administration of China (CAC) officially issued the ‘Provisions on Promoting and Regulating Cross-border Flow of Data’ (hereinafter referred to as ‘New Rules’), revamping the cross-border data transfer rules in place since 2022. The New Rules constituted a much-awaited announcement that is expected to lessen the administrative burdens and cross-border data transfer bottlenecks facing many companies, and provide a more internationalized environment for MNCs as well as Chinese local companies with overseas needs.

The 9th Europe Forum 2023 - Brussels

Forum Background

The comprehensive strategic partnership between the European Union (EU) and China turns 20 this year. Over the past two decades the EU and China, two of the world’s leading economies, have engaged in mutually beneficial cooperation in a win-win manner and achieved significant success in fields such as politics, economy, culture, and science. As of the end of 2022, EU-China bilateral trade volume reached $847.3 billion, with each side the second-largest trading partner of the other. The stock of two-way investment between China and the EU has exceeded $230 billion, benefiting people on both sides and contributing greatly to world peace and economic prosperity.

Looking ahead, the two sides hold great potential for cooperation and share common interests in promoting economic growth and financial stability, coping with the energy crisis, curbing inflation, and pursuing green and digital transitions. As such, they have decided to set up a financial working group under the China-EU High-Level Economic and Trade Dialogue (HED) mechanism to strengthen cooperation in financial areas such as financial liberalisation, infrastructure, and regulation, as well as sustainable finance and fintech. However, some tension does exist within the relationship – EU authorities have recently opened an anti-subsidy investigation into Chinese electric car imports, for example.

On 13 July 2023, the Cyberspace Administration of China, together with six other government agencies, jointly released China’s very first regulatory document governing generative artificial intelligence (AI) – Interim Measures on the Administration of Generative AI Services, which will become effective on 15 August 2023. The Measures apply to the use of generative AI technology to provide, to the general public within the Chinese territory, services generating texts, images, audio, video, or other such content, and set forth a series of compliance requirements relating to data, algorithms and content among other aspects. In the meantime, companies integrating AI into their business and operations also need to comply with broader data protection laws, regulations and standards, and make necessary adaptations to their existing compliance regime.

2023年7月13日,国家网信办、国家发改委、教育部、科技部、工信部、公安部以及广电总局联合发布了中国首份生成式人工智能监管文件——《生成式人工智能服务管理暂行办法》,后者将于2023年8月15日正式施行。《办法》适用于利用生成式人工智能技术向中国境内公众提供生成文本、图片、音频、视频等内容的服务,并就此提出了数据、算法、内容等方面的一系列合规义务。与此同时,企业在进行人工智能落地实践过程中,同样面临更为广泛的数据保护相关法律、法规、标准的要求,并需对既有合规体系进行必要调整。

5月30日,国家互联网信息办公室发布《个人信息出境标准合同备案指南(第一版)》(“备案指南”),为6月1日起执行标准合同的备案工作提供了指引,对个人信息出境标准合同备案方式、备案流程、备案材料等具体要求作出了说明。

On 30th May, the Cyberspace Administration of China (CAC) issued the Guidelines for Filing Standard Contracts for the Cross-Border Transfer of Personal Information (First Edition) (‘Filing Guidelines’), which provided guidance for the filing of standard contracts effective as of 1st June. The guidelines provided specific requirements for the filing methods, filing procedures, and filing materials for Standard Contract for Cross-border Transfer of Personal Information.

At the end of 2022, the Central Committee of the Communist Party of China and the State Council issued the Opinions on Building Basic Systems for Data to Better Give Full Play to the Role of Data Resources (Twenty Data Measures), proposing twenty measures for the establishment of a property system, a circulation and trading system, an income distribution system, and a governance system. The Twenty Data Measures aim at fully leveraging China’s abundant data resources and rich application scenarios, tapping into the potential of data resources, and shedding light on the Chinese-style data governance.
