President Joerg Wuttke expressed his appreciation to Director General Xu, stating that the European Chamber has always supported the establishment of an anti-monopoly framework in China, recognizing the significance of the Anti-Monopoly Law in promoting healthy economic development and safeguarding fair competition and consumer rights. The Chamber appreciates DG Xu’s explanation of the related legal principles, system and procedures of China’s Anti-Monopoly Law. The Chamber applauds NDRC’s plan in further strengthening information disclosure. The Chamber hopes to, through increased transparency guidance and education, enhance its member companies’ understanding and awareness of competition law and policies. The European Chamber is looking forward to strengthening mutual understanding, maintaining close communication and cooperation with NDRC and jointly promoting fair competition rules.

Director General Xu Kunlin stated that China is actively pushing forward pricing reforms and largely reducing the number of government pricing items. At the same time, China will further strengthen in- and post-process supervision, including anti-monopoly enforcement, in order to enhance the market’s decisive role in resource allocation as well as the government function, creating a market environment based on fair competition for all businesses. Director General Xu further stated that NDRC has carried out its anti-monopoly enforcement strictly adhering to the law, and has treated all companies fairly regardless of their nationality and ownership, protecting their legal rights to state, argue, apply for hearings as well as to file for administrative reconsideration and litigation. NDRC hopes that the European Chamber may actively play its role as a Chamber by raising questions of concern to companies, helping them operate in good faith and achieve better development in China.

As an initial step, NDRC and the European Chamber have agreed to hold a joint seminar on the Anti-Monopoly Law for European member companies.

欧盟商会主席伍德克一行会见国家发展改革委价格监督与反垄断局许昆林局长

 2014年11月28日上午，欧盟商会主席伍德克一行前往国家发改委拜会了价格监督与反垄断局许昆林局长。双方就反垄断、药品价格改革等有关问题进行了沟通交流。

伍德克主席表示，感谢许昆林局长在繁忙的工作中抽时间会见，欧盟商会一直支持反垄断框架在中国的建立，认为反垄断法律对促进经济健康发展、维护公平竞争和消费者利益至关重要。欧盟商会感谢许昆林局长对相关法律原则、制度和程序的解读，对国家发展改革委进一步加强信息公开工作表示赞赏，希望通过增加透明度引导、教育企业，增强企业对竞争法律政策的理解和认知。欧盟商会期待着增强与国家发展改革委反垄断局的相互理解，在今后保持密切的沟通协作，共同维护公平竞争秩序。

许昆林局长表示，当前中国价格改革在加快推进，政府定价项目将大幅度减少，与此同时也将进一步加强包括反垄断执法在内的事中事后监管，更好发挥市场在资源配置中的决定性作用和政府作用，为所有企业创造公平竞争的环境。许昆林局长进一步表示，国家发展改革委始终坚持依法开展反垄断工作，无论其投资来源地或股权结构，对所有企业一视同仁，依法保障被调查企业进行陈述申辩、申请听证和提起行政复议、行政诉讼的权利。希望欧盟商会能积极发挥其作用，提出企业关心的问题，帮助企业合规经营，在中国取得更好发展。

作为加强沟通协作的第一步，国家发展和改革委与欧盟商会将会在近期合作举办面向商会会员企业的反垄断法培训说明会。
