Meeting with SAIC on Revised Anti-unfair Competition Law

Chamber General Manager Mr Carl Hayward welcomed the keynote speaker Mr Yang Hongcan, Director General, Antimonopoly and Anti-unfair Competition Enforcement Bureau of State Administration of Industry & Commerce (SAIC), and made the opening remarks on the newly revised Anti-unfair Competition Law (AUCL).

Subsequently, Mr Yang Hongcan made the keynote speech and interpreted the newly revised AUCL. As he pointed out, six updates are highlighted in the revision, including more clear definition for business operator and activities of unfair competition, greater importance attached to the protection of consumer and business operators’ rights and interests, additional articles added regarding undertakings of confusion, compliance requirements in production and business activities by using the Internet, AUCL’s relationship with other legal systems including but limited to the Trademark Law, Antimonopoly Law, Advertisement Law, Law on Bid Invitation and Bidding, Law on the Protection of Consumer Rights and Interests, more mandatory measures for coordinated administrative enforcement and more specified legal liabilities.

A Q&A session was followed with the panel moderated by Mr Johnny Zhao, Senior Representative of Legal and Competition Working Group. A number of questions, particularly the ones regarding Article 2, Article 6, Article 7, Article 9 and Article 12 of AUCL were addressed adequately by Mr Yang Hongcan and Ms Du Changhong, Director, Antimonopoly and Anti-unfair Competition Enforcement Bureau of SAIC.
